Construction
Most construction rules and regulations are governed by the Town (Islip or Brookhaven) where your property is located. However, there are some local Seaview regulations you need to know. Our By-Laws limit when construction can take place:
ARTICLE XV - MAJOR CONSTRUCTION
A. No landowner shall permit major construction on their property, as defined in subparagraph (B) below, in Seaview between July 1st and Labor Day of any calendar year.
B. Major construction shall be defined as any construction that takes more than three (3) days to complete.
C. All non-major construction between July 1st and Labor Day shall be limited to Monday and Friday between the hours of 9 am to 4 p.m. and shall be prohibited on July 4th.
D. The Board of Directors is authorized to impose a special assessment upon any Member violating this Article in the sum of Five Hundred Dollars ($500.00) per day for each day that the construction exceeds three (3) days.
E. In addition to the imposition of the special assessment provided in subparagraph D above, the Board of Directors is hereby also authorized to seek injunctive relief to enjoin any violation of this Article and to pursue any other rights and remedies available under law and in equity to enforce this Article.
If your project involves jetting posts or any other construction that will require a large amount of water, make sure your contractor requests the permission of the Seaview Association in advance (call 800-832-9422). They will need to file a “Request To Use Seaview Water” and file appropriate documentation in advance of any jetting. We will be charging per pole that has to be jetted and conducting an inspection afterward. Violation of this Seaview Regulation will lead to an immediate suspension of their permission to use Seaview water and possible significant fines and possible State criminal charges.
